Abstract
Dünyada ve ülkemizde meydana gelen teknolojik gelişmelere paralel olarak şirketler de büyük bir rekabet ortamında bulunduğundan, iş dünyasında yoğun bir çalışma temposumeydana gelmiştir. Bu nedenle günümüzde birçok şirket nitelikli işgücüne sahip olabilmek için bünyesinde bulunan işçisine eğitim imkanı sağlamakta ve ekonomik olarak büyük biryükün altına girmektedir. İşveren tarafından, yapılan bu harcamaları garanti altına alabilme ve iş sözleşmesinin işçi tarafından haksız olarak süresinden önce feshine engel olabilmek için iş sözleşmelerinde cezai şart, öngörülmektedir. Bu tez çalışması ile cezai şartın iş hukuku alanında uygulanması işçi ve işveren yönünden etkileri ile cezai şartın uygulanması bakımından işverenin ispat yükü, eğitim giderlerinin geri ödenmesi durumunda gözetilecek hususlar anlatılmaya çalışılmıştır.

By the employer, isanticipated made to guarantee that spending by workers and the labor agreement as unfair tothe period before the termination of contracts in order to avoid punitive conditions. This thesiswith a penal clause are presented of the labor law in the implementation of workers andemployers in terms of impact with the punitive terms of the purpose of applying theemployer's burden described of proof, training costs reimbursement in the case consideringthe issues. Workers, can happen as a result of this quality education throughout the entireworking life at the point of his career success, while employers have the skilled labor as wellas strong positions in a competitive environment.
