Abstract
Bu çalışmanın amacı, işçinin mesleki yaşam-özel yaşam dengesine ilişkin Türk hukuku düzenlemelerinin uluslarüstü hukuk, Avrupa Konseyi ve Avrupa Birliği düzenlemeleri, Fransız İş Kanunu ve ilgili diğer ülke hukukları çerçevesinde iş-yaşam dengesinin sağlanmasında ne ölçüde yeterli olduğunu tespit etmektir. Bu doğrultuda, işçiyi gözetme borcu bağlamında işçinin kişisel yaşamının korunması ilkesinden hareket edilmekte ve işçinin iş dışında bir yaşamının bulunması gerekliliğine vurgu yapılmaktadır. İşçinin kişisel yaşamının korunması için kişisel yaşamı mesleki yaşamı ile uyumlu hale getirilmeli, bu konuya ilişkin yasal düzenlemeler bireyin kişiliğini geliştirmeyi, aile yaşamı ve sağlığını korumayı amaçlamalıdır. Çalışmamızda, Türk hukukundaki bu düzenlemeler irdelenmiş ve öğreti görüşleri ile yargı kararları da dikkate alınarak düzenlemelerin iş-yaşam dengesindeki rolü ve ihlallerinin hukuki sonuçları değerlendirilmiştir. Mesleki yaşam-özel yaşam dengesine dair Türk hukukunda işçinin iş-yaşam dengesini sağlamasını kolaylaştıracak özel düzenlemeler bulunmaktadır ancak bu düzenlemeler işçinin ailevi yükümlülükleri, sağlığının korunması, dinlenme hakkı ve kişiliğinin geliştirilmesi açısından boşluklar içermektedir. Türk iş hukukunun, işçinin iş-yaşam dengesinin sağlanmasını iş ilişkisinin temel bir unsuru olarak kabul eden pozitif düzenlemelere ihtiyacı bulunmaktadır.
The aim of this study is to determine to what extent the Turkish legal regulations regarding the professional life-private life balance of the employee are sufficient for providing work-life balance within the framework of supranational law, the Council of Europe and the European Union regulations, French Labor Law and the laws of other relevant countries. In this direction, the principle of protecting the personal life of the employee in the context of the duty of care of the employee is taken into consideration and it is emphasized that the employee must have a life outside of work. In order to protect the personal life of the employee, her/his personal life should be harmonized with his professional life, legal regulations on this subject should aim to develop the personality of the individual and protect her/his family life and health. In our study, these regulations in Turkish law were examined and the role of regulations in the work-life balance and the legal consequences of their violations were evaluated, taking into account doctrinal views and judicial decisions. There are special regulations in Turkish law on professional life-private life balance that will facilitate the employee's work-life balance, but these regulations contain gaps in terms of family obligations, protection of health, right to rest and development of personality. Turkish Labor Law needs positive regulations that accept the work-life balance of the employee as a fundamental element of the employment relationship.
