Türk Hukukunda Sporcuların Sigortalanması

Abstract

Bu çalışmada, Türk hukukunda sporcuların özel sigortalar kapsamında sigortalanması konusu incelenmeye çalışılmıştır. Sporcu sigortalarının önemi gün geçtikçe artmakla birlikte konuya ilişkin toplu ve düzenli bir mevzuat henüz mevcut değildir. Sporcu sigortaları, ayrı bir sigorta türü olmadığından mal sigortaları hariç her özel sigorta türü sporcular açısından da düzenlenebilmektedir. Burada sporcunun bu sigortalardan yararlanabilmesi için, sporu amatör olarak mı yoksa profesyonel olarak mı yaptığının önemi yoktur. Çalışmada sporcuların hangi sigorta türlerinden yararlanabilecekleri açıklanmaya çalışılmış ve sporcu sigorta sözleşmelerinin riziko ve teminatlarının sınırı belirlenmeye çalışılmıştır.

In this study, the issue of insuring athletes within the scope of private insurances was tried to be examined in Turkish law. Although the importance of sports insurance is increasing day by day, there is no collective and regular legislation on the issue yet. Since athlete insurance is not a separate type of insurance, every type of private insurance except property insurance can be regulated for athletes. In order for the athlete to benefit from these insurances, it does not matter whether he or she is doing the sports as an amateur or professional. In this study, it was tried to explain which types of insurance that athletes can benefit from and in this context, the conclusion of the insurance contract, its provisions, the rights and obligations of the parties and the termination of contract were discussed.
