The Exploitation of Children in Media, the Right to Be Forgotten and Türki̇ye’s Stance

Abstract

Çocukların süjesi olduğu dijital içeriğiklerin hacmi zaman içinde hızla artmaktadır. Bu durum hem çocukların sosyal medyayı aktif olarak kullanmasının hem de sharenting(ebeveynlerin reşit olmayan çocuklarının verilerini çevrimiçi olarak paylaşmalarının) uygulamasının yaygınlaşmasının bir sonucudur. Çocuklar, kişisel verilerinin çevrimiçi olarak paylaşılmasıyla daha olgunluk çağına ulaşmadan oldukça büyük bir dijital ayak izi edinmektedir. Bu makale, çocuklara yönelik mevcut çevrimiçi ortamı, ebeveynler tarafından bu ortamda oluşturulabilecek olumsuzlukları inceleyeceğiz ve Avrupa Birliği Genel Veri Koruma Tüzüğü’nün unutulma hakkına yönelik düzenlemesini ve bu hakkın kapsamını ele alacağız. AB ve Türkiye açısından unutulma hakkı kavramının durumu karşılaştırıp, Türk mevzuatında değişiklik yapılmasına gerek olup olmadığına karar vereceğiz.

The volume of digital content that features children has grown rapidly over time. This is a result of children being active social media users and the popularisation of sharenting(parents sharing their minor children’s data online). Through an abundance of their personal data being shared online, children acquire a rather large digital footprint even before they reach the age of maturity. This article looks at the current online climate featuring children, the adverse effects of such a practice and how The European Union’s General Data Protection Regulation attempts to regulate this sphere by introducing the right to be forgotten and the scope of this right. We will compare the situation regarding the EU and Türkiye and determine whether a change in the Turkish legislation is needed.
